Terms of Service

1. DEFINITIONS

For purposes of these Terms of Service, the following terms have the meaning set forth below. “Life Quality Pet Care” means Gleason Vet LLC, which may also be referred to as ‘we’, ‘us’ or ‘our’ as the context requires. “Terms” means the Gleason Vet LLC Terms of Service and Privacy Policy. “Website” means the website of lifequalitypetcare.com together with, unless the context otherwise requires, its content.


2. TERMS OF SERVICE


A. Instructions

We cannot accept instructions from anybody under the age of 18 years or if you do not permanently reside in the United States of America (“USA”), or if you are not at least 18-years of age. In certain situations, we understand that requests will be made by persons acting as your agent, such as pet carer, cattery/kennel owner, etc. We will assume unless advised in writing by yourself, that they have your authority and are acting in your interest and on your behalf. Requests for any account details to be changed must be made in writing by the account holder.


B. Services

Life Quality Pet Care is a veterinary service, specializing in rehabilitation services (e.g., rehabilitation, acupuncture, laser therapy, food therapy, and at-home euthanasia services) for domestic pets. That is to say, we provide the best possible specific veterinary services. We have limited equipment and the ability to perform only those treatments and investigations specifically offered by Life Quality Pet Care. Consultations are typically performed in our office or through telemedicine. However, we are not a veterinary hospital and do not have the associated facilities to treat pets requiring hospitalization, x-ray, surgery, vaccines, laboratory services including blood work, or other veterinary hospital services. If you are happy with the limitations, we are happy to accommodate you as best we can. In filling in the registration request form or registering by phone you are requesting specific services from Life Quality Pet Care. This is to include ONLY the services recommended and/or offered by Life Quality Pet Care.


C. Routine Veterinary Care and Emergency Treatment

In filling in the registration request form or registering by phone you are agreeing that you will continue to utilize a veterinary hospital for ALL other veterinary services not offered or recommended to be performed by Life Quality Pet Care such as routine veterinary care (e.g., lab work, vaccinations) and emergency treatment.


D. Medication

We cannot supply medication on prescription without first seeing your pet. Repeat prescriptions can only be given if the animal is under the direct care and attention of Life Quality Pet Care, and we reserve the right in certain circumstances to re-examine the animal again before prescribing. All prescriptions must be paid for in advance unless otherwise agreed to by Life Quality Pet Care.


E. Insurance

It is your responsibility to submit claim forms to us for completion. Insurance form administration is provided free of charge by us and all claim forms will be dealt with promptly. Only on rare occasions and by prior arrangement will we defer the ‘payment’ terms below, providing the insurance claim will be paid directly to Life Quality Pet Care and providing the insurance company has agreed in principle to settle the claim. In this circumstance, the client will still be required to pay any excess and costs not covered by the insurer and any costs later rejected by the insurer.


F. Treatment

Subject to our professional duties as veterinarians, we reserve the right to make final decisions on treatment. We retain the responsibility for case records. Although the client is charged for the taking, diagnosis, and advice of such case records, they do not buy ownership of them. In appropriate circumstances, copies can be forwarded to another veterinarian. We are unfortunately unable to answer queries here made by owners whose animals are not under our veterinary care. We suggest that you discuss your concerns with your own vet. They are in the best position to advise you since they have the benefit of knowing all about your animal and their relevant lab results etc.


G. Payment

We accept cash, checks, or credit cards for payments. We may require your credit card details prior to confirming your appointment. We shall, unless an alternate payment method has been agreed upon, charge your credit card after the appointment is completed. We aim to run a transparent pricing policy, with fair and competitive fees. We do recognize that there will be exceptional circumstances where emergencies occur and payment at the time will not be possible. Of course, such scenarios will be taken into consideration. To allow us to continue to provide a quality service, this condition will also apply to insured animals and it is the responsibility of the client to be reimbursed by the insurance company. In giving instructions, either in person or by your agent, for an animal to be treated, you will be responsible for our charges. Whenever possible we will give you an estimate of the cost of treatment, however, variations and complications may arise resulting in further costs being incurred.


H. Cancellation

If formal cancellation of a confirmed appointment is not requested more than 24 hours prior to the agreed-upon start time of said appointment, we reserve the right to charge a cancellation fee of no less than $99. You will be invoiced or your credit card will be charged accordingly. Reschedule requests not made more than 24 hours prior will also be charged an equivalent cancellation/rescheduling fee. Additionally, if your pet is deemed too aggressive or fractious to be examined safely or we are unable to perform the necessary veterinary services to appropriately treat your pet, you are still liable for the cost of the exam or the standard cancellation fee.


I. New clients

Details, including relevant medical history and records, may be requested from your regular veterinarian. It is your responsibility to obtain these records prior to the initial consultation and is in the interest of your pets’ welfare to ensure we know about any current medical conditions, the treatment being received, etc. All new clients are encouraged to carefully read these terms and conditions.


J. Complaints

We aim to offer all clients a professional, friendly, and efficient service and we hope that you will be pleased with the work we do for you. However, if any difficulty should arise, our approach is to be constructive. Every complaint will be taken seriously, will be investigated thoroughly and promptly, and remedial action will be taken as appropriate. K. Future work

Unless otherwise agreed, and subject to a possible revision of fees, these terms and conditions will apply to any future work by us on your behalf.


L. Limited License to Use Website

We grant you a nonexclusive, nontransferable, revocable, and limited license to use the Website in accordance with these Terms. Any copyright or attribution notice appearing on the original content or information must appear on all copies of the content or information. Any document created based on information from the Website is your work product, which you use at your own risk, and we assume no liability for its use.


M. No Commercial or Non-Permitted Usage

This Website is intended for use by individuals and other entities interested in the market, business, or other information concerning Life Quality Pet Care. We have exercised efforts to provide you with accurate information on the Website from public or other sources, but we are not in any way responsible for your use or reliance on such information, which is solely at your own risk. The use, reproduction, copying, resale, or redistribution of any non-public content of the Website for commercial or any other non-permitted purpose is prohibited without our prior written consent.


N. Unlawful Activity

You may not use the Website or its content in any way that violates the laws or regulations of any jurisdiction or any political subdivision thereof. We reserve the right to investigate complaints or reported or unreported violations of these Terms and to take any action deemed appropriate including, without limitation, reporting any suspected unlawful activity to law enforcement officials, regulators, or other appropriate third parties and disclosing any information necessary or appropriate to such persons or entities including, without limitation, information related to user profiles, e-mail addresses, usage history, posted materials, IP addresses, and traffic information.


O. Our Intellectual Property Rights

Except as expressly provided in these Terms, nothing contained herein shall confer, or shall be construed as conferring, any license or right, by implication, estoppel or otherwise, under the copyright or other intellectual property rights. You agree that the Website is or may be protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws, and may not be used except as provided in these Terms without our prior consent. You also agree that we retain all copyrights in the layout and graphics of the Website, the collective and compilation copyrights in all databases and navigation design in relation to the Website, and all content of the Website created by our employees, contractors, consultants, or other contributors.

R. Discontinuation

In the event of any change in laws or regulations or for any other commercially reasonable reason as determined by us acting in good faith, we reserve the right to discontinue the operation of the Website at any time.

In some cases, Life Quality Pet Care may choose to buy or sell assets. In these types of transactions, user information is typically one of the business assets that is transferred. Moreover, if Life Quality Pet Care, or substantially all of its assets, were acquired, user information would be one of the assets that are reviewed and transferred or acquired by a third party. You acknowledge that such transfers may occur and that any acquirer of Life Quality Pet Care may continue to use your personal information as set forth in this policy.


U. Not Investment or Legal Advice

The Website provides information concerning Life Quality Pet Care, but it is not a substitute for advice from a licensed professional. Your use of this site does not create any fiduciary relationship between you and us. AA. Dispute Resolution

Any controversy or claim arising out of or relating to your use of the Website or these Terms, which the parties are not able to resolve in an amicable fashion within a reasonable time, maybe settled by Nevada courts and each party submits to the non-exclusive jurisdiction of Courts in Douglas County, NV for that purpose. Each party will bear its own costs and expenses, including attorney fees and expenses, associated with any dispute.


BB. No Liability

You agree that we shall have no liability whatsoever in respect of any claims, losses, expenses, damages, or costs arising as a result of your use of or inability to use the Website or its content.


CC. Third-Party Rights

The Disclaimer, Limitation of Liability, and Dispute Resolution provisions are for our benefit and the benefit of any third party providing content to the Website. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its own behalf.
